FAA and TSA Publish Proposed “Beyond Visual Line of Sight” Rule for Unmanned Aircraft Systems

What: On August 7, 2025, the Federal Aviation Administration (FAA) and Transportation Security Administration (TSA) published a Notice of Proposed Rulemaking (NPRM) in the Federal Register seeking public comment on its proposed “Normalizing Unmanned Aircraft Systems for Visual Line of Sight Operations (“Beyond Visual Line of Sight” rule for Unmanned Aircraft Systems (UAS) (Drones)).

Why: FAA and TSA’s proposed rule seeks to support the integration of unmanned aircraft systems (UAS) into the national airspace system (NAS) by providing a predictable and clear pathway for safe, routine, and scalable UAS operations. These operations include package delivery, agriculture, aerial surveying, civic interest, operations training, demonstration, recreation, and flight testing. The proposed rule envisions performance-based regulations to enable the design and operation of UAS at low altitudes beyond visual line of sight (BVLOS) and for third-party services, including UAS Traffic Management (UTM), that support these operations.

TSA would make complementary changes to its regulations to ensure it can continue to impose security measures on these operations under its current regulatory structure for civil aviation.

Action: Read the proposed rule and submit comments to the FAA by October 6, 2025.
